Acceptance of Terms
By creating an account and using ParkEra, you unconditionally accept these Terms of Service.
Platform Description
ParkEra is a peer-to-peer marketplace that connects parking space owners (Owners) with drivers seeking parking (Drivers). We provide the platform and technology to facilitate these connections but are not responsible for the actual parking spaces or transactions between users.
Terms for Drivers / Renters
These Terms govern the use of the ParkEra platform by drivers who rent private parking spaces ("Drivers").
Use of Parking Space
The Driver is obligated to:
- Use only the space reserved through the app
- Respect the booking hours
- Respect the access and circulation rules of the building or area
Prohibited:
- Parking in a different space
- Transferring the booking to a third party without permission
- Using the space for purposes other than parking a private vehicle
Liability for Damages
The Driver is fully liable for:
- Any material damage to the parking space
- Damage to common areas, doors, ramps, barriers, or other vehicles
The Driver is obligated to compensate the Owner for any direct or indirect damage caused by their fault.
Fines – Illegal Parking – Penalties
In case of:
- Parking outside the reserved space
- Exceeding booking time
- Illegal parking in common areas
The Driver is solely responsible for any fine or administrative penalty and is obligated to pay any related fine or compensation.
ParkEra bears no responsibility for fines or penalties imposed.
Terms for Private Parking Space Owners
These Terms of Use govern the participation of private parking space owners ("Owners") on the ParkEra platform, through which temporary rental of private parking spaces to other users ("Drivers") is made possible.
Declaration of Ownership or Right of Use
The Owner declares and guarantees that:
- They are the legal owner of the parking space, or
- They have a legal and exclusive right to use and rent it (e.g., tenant with relevant permission, usufructuary, etc.)
The Owner bears exclusive responsibility for the legality of making the parking space available through ParkEra.
Required Documents for Proof of Ownership or Right of Use
To list and activate a parking space on the platform, the Owner is required to upload one or more of the following documents:
- Title Deed (purchase contract or parental gift) explicitly mentioning the parking space, or
- Copy of E9 tax form showing the specific parking space, or
- Horizontal Property Constitution / Building Regulations, showing that the space belongs exclusively to the Owner, or
- Lease Agreement, if the space is rented with explicit subletting permission, or
- Solemn Declaration (Law 1599/1986), in which the Owner declares responsibility that they are the legal holder and have the right to rent the specific space.
ParkEra reserves the right to request additional documents or clarifications before activating the space.
Compliance with Building Regulations and Legislation
The Owner declares that:
- Renting the parking space is not prohibited by the building regulations
- It does not violate the rights of co-owners or third parties
- They comply with the applicable tax and civil law regarding the rental of real estate or parking spaces
ParkEra bears no responsibility for any disputes with managers, co-owners, or third parties.
Responsibility for the Condition of the Space
The Owner must:
- Provide an accurate description of the space (dimensions, access, restrictions)
- Ensure the space is safe and suitable for parking
ParkEra operates exclusively as an intermediation platform and is not liable for damages, accidents, or disputes between Owner and Driver.
Tax Obligations
The Owner is exclusively responsible for:
- Declaring income from rentals
- Payment of any tax or contribution required by law
ParkEra does not provide tax or legal advice.
Sanctions and Account Deactivation
In case of:
- Submitting false information
- Lack of legal right to rent
- Violation of these Terms
ParkEra may suspend or delete the Owner's account without notice.
Limitation of ParkEra Liability
ParkEra:
- Is not the owner of the parking spaces
- Is not responsible for accidents, damages, or losses
- Operates exclusively as an intermediation platform
Damages & Civil Liability Clause
ParkEra is not liable for:
- Theft, damage, or loss of vehicle
- Damages caused by third parties
- Accidents within or around the parking space
The Owner and the Driver are exclusively responsible for:
- Vehicle safety
- Compliance with the Road Traffic Code
- Resolution of any disputes between them
ParkEra does not replace insurance coverage.
Fines & Illegal Parking Clause
The Driver acknowledges that:
- Any fine, ticket, or administrative penalty imposed due to parking is solely their responsibility
- ParkEra is not responsible for actions of municipal authorities, police, or building managers
If a fine is imposed on the Owner due to the Driver's fault, the Driver is obligated to fully compensate them.
